How Trafficking Differs from Distribution in Wyoming
When the amount of controlled substances involved in drug trafficking in Wyoming is above certain levels, Wyo. Stat. § 35-7-1031 and related laws come into play. These levels lead to longer mandatory minimum sentences and much higher maximum penalties. The amounts that are too much depend on the drug. For example, methamphetamine, cocaine, heroin, and fentanyl all have their own limit amounts. When the amount of drugs being sold is high enough, the assumption changes from personal use or distribution to a higher-level operation.
When the amounts involved are large, the investigation crossed state lines, or federal law enforcement agencies were involved, federal drug trafficking charges often go along with state trafficking prosecutions. Federal trafficking has its own minimum sentences that must be followed, and these can be much longer than state minimums.
Mandatory Minimum Sentences in Wyoming Trafficking Cases
Wyoming law requires judges to give certain minimum sentences that they can’t lower, even if there are reasons to do so.
