How Trafficking Differs from Distribution in Wyoming

When the amount of controlled substances involved in drug trafficking in Wyoming is above certain levels, Wyo. Stat. § 35-7-1031 and related laws come into play. These levels lead to longer mandatory minimum sentences and much higher maximum penalties. The amounts that are too much depend on the drug. For example, methamphetamine, cocaine, heroin, and fentanyl all have their own limit amounts. When the amount of drugs being sold is high enough, the assumption changes from personal use or distribution to a higher-level operation.

When the amounts involved are large, the investigation crossed state lines, or federal law enforcement agencies were involved, federal drug trafficking charges often go along with state trafficking prosecutions. Federal trafficking has its own minimum sentences that must be followed, and these can be much longer than state minimums.

Mandatory Minimum Sentences in Wyoming Trafficking Cases

Wyoming law requires judges to give certain minimum sentences that they can’t lower, even if there are reasons to do so. One of the first things we look at in every trafficking case is whether the amounts in question trigger mandatory minimums and whether those amounts are correctly described. Disagreements over quantity, problems with testing methods, and hiding evidence can all affect whether mandatory minimums apply.

How We Defend Drug Trafficking Charges in Wyoming

The Fourth Amendment question for trafficking defense is the same as for other drug cases: was the stop and search legal? – along with quantity analysis (are the weights correct and measured consistently?), chain of custody checks, reviews of lab testing methods, and challenges to the credibility of informants. We also look at federal sentencing guidelines and factors that affect cooperation when they are relevant. These are complicated cases that need a lot of experience and thorough defense from the start.

What Clients Say About Just Criminal Law

Frequently asked questions about drug trafficking charges in Wyoming

Under Wyoming and federal law, the amount of a substance that can lead to trafficking charges is different for each substance. There are certain weight limits for methamphetamine, heroin, cocaine, and fentanyl that, if crossed, will result in trafficking-level charges. These limits are lower than most people think, especially for fentanyl and other very strong drugs. In each case, we look at the specific amounts that are said to be involved and the limits that apply.

Yes, a lot. Federal trafficking charges are handled in federal district court and follow federal law. They have their own minimum sentences, and federal sentencing guidelines can lead to sentences that are much longer than state minimums. We can file both federal and state charges for the same behavior, and we have to deal with both systems at the same time when both are active.

Yes, in some cases. For example, by hiding evidence that lowers the amount below trafficking thresholds, by arguing over the amount that lowers the charge level, or by making a deal to plead guilty. In some trafficking cases, people are asked to work with the federal or state government. We look at all possible outcomes for each case and never suggest cooperation until we fully understand what it means.

Distribution usually means selling or giving away controlled substances, no matter how much. Trafficking happens when the amount involved goes over certain limits. The charge and penalties go up even if the distribution part isn’t there. Trafficking charges mean that the operation is at a higher level and carry the harshest drug penalties in Wyoming law.
