    Drug Charges in Casper: What You Are Up Against

    Natrona County has one of the highest numbers of criminal cases in Wyoming. Misdemeanors are tried in circuit court and felonies are transferred to the Natrona County District Court, located at 200 N. Center Street. The 7th Judicial District is responsible for handling these cases. Casper police, county deputies, the Division of Criminal Investigation and the Drug Enforcement Agency all work on drug cases here.

    Three factors determine your exposure: the substance, its weight, and whether the state believes you intended to sell it.

    Wyoming Drug Schedules Determine the Charge

    Wyoming sorts controlled substances into five schedules under the Wyoming Controlled Substances Act, Wyo. Stat. § 35-7-1001 et seq. The ceiling for the quantity of a substance is set before it is even discussed, depending on where your substance falls.

    • Schedule I (§ 35-7-1014): Heroin, LSD, MDMA, Psilocybin, and Marijuana.
    • Schedule II (§ 35-7-1016): Methamphetamine, Cocaine, Fentanyl, Oxycodone, Morphine. Most Casper felony drug cases involve drugs on this list.
    • Schedules III through V (§§ 35-7-1018 through 35-7-1022): Ketamine, Xanax, Codeine cough preparations. Prescription pills are counted here when they are not your own.

    Note the third possession row. A third conviction is a felony, even when the amount is trivial. Convictions from other states also count toward that total.

    Distribution is where the penalties become severe, as selling meth or a Schedule I or II drug can lead to a sentence of up to twenty years in prison. You don’t have to be caught in the act of selling. Prosecutors will argue about intent based on weight, packaging, scales, cash, and text messages, and this is usually the main focus in a Casper felony case.

    I-25 Stops Near Casper: What Happens After the Lights Come On

    I-25 carries traffic from the southwest border north through Casper towards I-90, and law enforcement treats the corridor accordingly. Troopers, deputy sheriffs, and federal task force officers all work to prevent illegal activity on that stretch of road. Summer is the busiest time of year.

    Wyoming gives some first-time defendants a path that ends without a conviction. Each one has a gate, and the gate closes.

    • First offender drug probation (§ 35-7-1037). The court defers the proceedings without entering a judgment and dismisses the case if the defendant completes probation. This is a one-time offer.
    • Deferred prosecution (§ 7-13-301). Probation for up to three years with dismissal upon completion, with no conviction on the record. Also a one-time opportunity.
    • Natrona County drug court (§ 7-13-1601). Intensive supervision, frequent testing, and treatment in place of incarceration. A demanding program, but worth it for the right clients. The district attorney’s office determines who qualifies.

    These options are one-time only, and eligibility can be easily lost. Pleading at arraignment, talking to investigators, or picking up a new charge while the first case is pending could close the door permanently.

Wyoming is one of the stricter states on marijuana enforcement.

According to Rodriguez, police can only hold you for the time necessary to handle a traffic violation without additional grounds. If this happens, the evidence against you may be suppressed.     Some drug convictions can be expunged in Wyoming under W.S. 7-13-1501.
