Court structure South Dakota uses a unified circuit court system. Unlike Wyoming — where misdemeanors start in circuit court and felonies go to district court — all South Dakota criminal matters are heard in the circuit court from the start. There is no separate circuit and district court structure. Your first appearance, bond hearing, and all subsequent proceedings happen in the same court.
DUI law South Dakota’s DUI law (.08% BAC threshold) mirrors Wyoming’s at the basic level, but the procedures, implied consent provisions, and license consequences differ. South Dakota has its own implied consent process and its own administrative license revocation procedures.
