Underage DUI

Underage DUI

Hi. This is Christina Williams from Just Criminal Law. It's all we do. After graduation, your young adult is probably making plans to leave home and head off to the military or college or start a new job. It's important to let them know what can happen if they're pulled over in their car with any alcohol in their system. Here are three facts about the law you can share with them. Number one, unlike a regular DUI to be charged with an underage DUI. Someone under 21 does not need to show any signs of being intoxicated. Rather, the mere presence of alcohol on their breath is enough to charge them with a DUI and illegal consuming alcohol or a MIC. Number two, to be found guilty of an underage DUI, the state must only prove that their alcohol level was a point of 2% that usually is less than one drink. And number three, if they're convicted of an underage DUI, your young adult will face a driver's license suspension and higher insurance rates. And finally, number four, the law treats an underage DUI similar to a regular DUI. Meaning if they get another DUI within five years, it's considered a second offense and then they face the same steep penalties, including mandatory jail time and an ignition interlock. As you can see, the law has zero-tolerance for underage drinking and driving. So let your young adult know how important it is to have a plan before they go out to a college party or some other event. They need to either leave the car at home or volunteer to be the designated driver By becoming educated, you can protect yourself and your family. If you find yourself in a situation where you're being questioned by the police, you should do these three things. Number one, tell them you don't want to discuss your day and ask if you're free to leave. Number two, let them know you want to talk to a lawyer. And number three, contact just criminal law.
