Blood or Breath for DUI?
Sometimes people think when they get a DUI it's impossible to fight. But the truth is, there's lots of ways to fight it, so you definitely should. After all, getting convicted might mean losing your license or even your job. In this short video, I'll tell you about one of the best ways you can fight your DUI. That is finding that the blood or breath test wasn't done correctly when you stop for a DUI. The police are going to test you to determine your blood alcohol level or BAC in one of two ways. Either having you blow into a breathalyzer or by sampling your blood. Both tests can be done wrong, which means your case gets thrown out. First of all, look at the breath test. There's a right way and a wrong way to do the test. The law requires a very specific procedure to be followed. Exactly. There are times the police don't follow the procedures carefully, but you have to know what to look for. If it has been shown that they didn't follow the rules and that they gave your test improperly, your breath test can be thrown out the other way. The police can determine your BAC is by taking a blood sample. They'll do this just like at the doctor's office with a needle. But if your blood results seem higher than they should be, it could be due to contamination of the sample. That can happen if they use rubbing alcohol to sterilize the puncture site. Or if they happen to keep the blood vial at the wrong temperature before it goes to the lab. Or maybe the blood sample was taken from a vein rather than an artery.
